Sociobiology

Sociobiology is a field of biology that aims to examine and explain social behavior in terms of evolution. It draws from disciplines including psychology, ethology, anthropology, evolution, zoology, archaeology, and population genetics. Within the study of human societies, sociobiology is closely allied to evolutionary anthropology, human behavioral ecology and evolutionary psychology.

Sociobiology investigates social behaviors such as mating patterns, territorial fights, pack hunting, and the hive society of social insects. It argues that just as selection pressure led to animals evolving useful ways of interacting with the natural environment, so also it led to the genetic evolution of advantageous social behavior.

While the term "sociobiology" originated at least as early as the 1940s, the concept did not gain major recognition until the publication of E. O. Wilson's book Sociobiology: The New Synthesis in 1975. The new field quickly became the subject of controversy. Critics, led by Richard Lewontin and Stephen Jay Gould, argued that genes played a role in human behavior, but that traits such as aggressiveness could be explained by social environment rather than by biology. Sociobiologists responded by pointing to the complex relationship between nature and nurture.

Definition

Sociobiology is based on the premise that some behaviors (social and individual) are at least partly inherited and can be affected by natural selection. It begins with the idea that behaviors have evolved over time, similar to the way that physical traits are thought to have evolved. It predicts that animals will act in ways that have proven to be evolutionarily successful over time. This can, among other things, result in the formation of complex social processes conducive to evolutionary fitness.

The discipline seeks to explain behavior as a product of natural selection. Behavior is therefore seen as an effort to preserve one's genes in the population. Inherent in sociobiological reasoning is the idea that certain genes or gene combinations that influence particular behavioral traits can be inherited from generation to generation.

For example, newly dominant male lions often kill cubs in the pride that they did not sire. This behavior is adaptive because killing the cubs eliminates competition for their own offspring and causes the nursing females to come into heat faster, thus allowing more of his genes to enter into the population. Sociobiologists would view this instinctual cub-killing behavior as being inherited through the genes of successfully reproducing male lions, whereas non-killing behavior may have died out as those lions were less successful in reproducing.

History

The philosopher of biology Daniel Dennett suggested that the political philosopher Thomas Hobbes was the first sociobiologist, arguing that in his 1651 book Leviathan Hobbes had explained the origins of morals in human society from an amoral sociobiological perspective.

The geneticist of animal behavior John Paul Scott coined the word sociobiology at a 1948 conference on genetics and social behaviour which called for a conjoint development of field and laboratory studies in animal behavior research. With John Paul Scott's organizational efforts, a "Section of Animal Behavior and Sociobiology" of the Ecological Society of America was created in 1956, which became a Division of Animal Behavior of the American Society of Zoology in 1958. In 1956, E. O. Wilson came in contact this emerging sociobiology through his PhD student Stuart A. Altmann, who had been in close relation with the participants to the 1948 conference. Altmann developed his own brand of sociobiology to study the social behavior of rhesus macaques, using statistics, and was hired as a "sociobiologist" at the Yerkes Regional Primate Research Center in 1965. Wilson's sociobiology is different from John Paul Scott's or Altmann's, insofar as he drew on mathematical models of social behavior centered on the maximisation of the genetic fitness by W. D. Hamilton, Robert Trivers, John Maynard Smith, and George R. Price. The three sociobiologies by Scott, Altmann and Wilson have in common to place naturalist studies at the core of the research on animal social behavior and by drawing alliances with emerging research methodologies, at a time when "biology in the field" was threatened to be made old-fashioned by "modern" practices of science (laboratory studies, mathematical biology, molecular biology).

Once a specialist term, "sociobiology" became widely known in 1975 when Wilson published his book Sociobiology: The New Synthesis, which sparked an intense controversy. Since then "sociobiology" has largely been equated with Wilson's vision. The book pioneered and popularized the attempt to explain the evolutionary mechanics behind social behaviors such as altruism, aggression, and nurturance, primarily in ants (Wilson's own research specialty) and other Hymenoptera, but also in other animals. However, the influence of evolution on behavior has been of interest to biologists and philosophers since soon after the discovery of evolution itself. Peter Kropotkin's Mutual Aid: A Factor of Evolution, written in the early 1890s, is a popular example. The final chapter of the book is devoted to sociobiological explanations of human behavior, and Wilson later wrote a Pulitzer Prize winning book, On Human Nature, that addressed human behavior specifically.

Edward H. Hagen writes in The Handbook of Evolutionary Psychology that sociobiology is, despite the public controversy regarding the applications to humans, "one of the scientific triumphs of the twentieth century." "Sociobiology is now part of the core research and curriculum of virtually all biology departments, and it is a foundation of the work of almost all field biologists" Sociobiological research on nonhuman organisms has increased dramatically and continuously in the world's top scientific journals such as Nature and Science. The more general term behavioral ecology is commonly substituted for the term sociobiology in order to avoid the public controversy.

Theory

Sociobiologists maintain that human behavior, as well as nonhuman animal behavior, can be partly explained as the outcome of natural selection. They contend that in order to fully understand behavior, it must be analyzed in terms of evolutionary considerations.

Natural selection is fundamental to evolutionary theory. Variants of hereditary traits which increase an organism's ability to survive and reproduce will be more greatly represented in subsequent generations, i.e., they will be "selected for". Thus, inherited behavioral mechanisms that allowed an organism a greater chance of surviving and/or reproducing in the past are more likely to survive in present organisms. That inherited adaptive behaviors are present in nonhuman animal species has been multiply demonstrated by biologists, and it has become a foundation of evolutionary biology. However, there is continued resistance by some researchers over the application of evolutionary models to humans, particularly from within the social sciences, where culture has long been assumed to be the predominant driver of behavior.

Sociobiology is based upon two fundamental premises:

  • Certain behavioral traits are inherited,
  • Inherited behavioral traits have been honed by natural selection. Therefore, these traits were probably "adaptive" in the environment in which the species evolved.

Sociobiology uses Nikolaas Tinbergen's four categories of questions and explanations of animal behavior. Two categories are at the species level; two, at the individual level. The species-level categories (often called "ultimate explanations") are

  • the function (i.e., adaptation) that a behavior serves and
  • the evolutionary process (i.e., phylogeny) that resulted in this functionality.

The individual-level categories (often called "proximate explanations") are

Sociobiologists are interested in how behavior can be explained logically as a result of selective pressures in the history of a species. Thus, they are often interested in instinctive, or intuitive behavior, and in explaining the similarities, rather than the differences, between cultures. For example, mothers within many species of mammals – including humans – are very protective of their offspring. Sociobiologists reason that this protective behavior likely evolved over time because it helped the offspring of the individuals which had the characteristic to survive. This parental protection would increase in frequency in the population. The social behavior is believed to have evolved in a fashion similar to other types of nonbehavioral adaptations, such as a coat of fur, or the sense of smell.

Individual genetic advantage fails to explain certain social behaviors as a result of gene-centred selection. E.O. Wilson argued that evolution may also act upon groups. The mechanisms responsible for group selection employ paradigms and population statistics borrowed from evolutionary game theory. Altruism is defined as "a concern for the welfare of others". If altruism is genetically determined, then altruistic individuals must reproduce their own altruistic genetic traits for altruism to survive, but when altruists lavish their resources on non-altruists at the expense of their own kind, the altruists tend to die out and the others tend to increase. An extreme example is a soldier losing his life trying to help a fellow soldier. This example raises the question of how altruistic genes can be passed on if this soldier dies without having any children.

Within sociobiology, a social behavior is first explained as a sociobiological hypothesis by finding an evolutionarily stable strategy that matches the observed behavior. Stability of a strategy can be difficult to prove, but usually, it will predict gene frequencies. The hypothesis can be supported by establishing a correlation between the gene frequencies predicted by the strategy, and those expressed in a population.

Altruism between social insects and littermates has been explained in such a way. Altruistic behavior, behavior that increases the reproductive fitness of others at the apparent expense of the altruist, in some animals has been correlated to the degree of genome shared between altruistic individuals. A quantitative description of infanticide by male harem-mating animals when the alpha male is displaced as well as rodent female infanticide and fetal resorption are active areas of study. In general, females with more bearing opportunities may value offspring less, and may also arrange bearing opportunities to maximize the food and protection from mates.

An important concept in sociobiology is that temperament traits exist in an ecological balance. Just as an expansion of a sheep population might encourage the expansion of a wolf population, an expansion of altruistic traits within a gene pool may also encourage increasing numbers of individuals with dependent traits.

Studies of human behavior genetics have generally found behavioral traits such as creativity, extroversion, aggressiveness, and IQ have high heritability. The researchers who carry out those studies are careful to point out that heritability does not constrain the influence that environmental or cultural factors may have on those traits.

Criminality is actively under study, but extremely controversial. Various theorists have argued that in some environments criminal behavior might be adaptive. The evolutionary neuroandrogenic (ENA) theory, by sociologist/criminologist Lee Ellis, posits that female sexual selection have led to increased competitive behavior among men, leading to criminality in some cases. In another theory, Mark van Vugt argues that a history of intergroup conflict for resources between men have led to differences in violence and aggression between men and women. The novelist Elias Canetti also has noted applications of sociobiological theory to cultural practices such as slavery and autocracy.

Support for premise

Genetic mouse mutants illustrate the power that genes exert on behaviour. For example, the transcription factor FEV (aka Pet1), through its role in maintaining the serotonergic system in the brain, is required for normal aggressive and anxiety-like behavior. Thus, when FEV is genetically deleted from the mouse genome, male mice will instantly attack other males, whereas their wild-type counterparts take significantly longer to initiate violent behaviour. In addition, FEV has been shown to be required for correct maternal behaviour in mice, such that offspring of mothers without the FEV factor do not survive unless cross-fostered to other wild-type female mice.

A genetic basis for instinctive behavioural traits among non-human species, such as in the above example, is commonly accepted among many biologists; however, attempting to use a genetic basis to explain complex behaviours in human societies has remained extremely controversial.

Reception

Steven Pinker argues that critics have been overly swayed by politics and a fear of biological determinism, accusing among others Stephen Jay Gould and Richard Lewontin of being "radical scientists", whose stance on human nature is influenced by politics rather than science, while Lewontin, Steven Rose and Leon Kamin, who drew a distinction between the politics and history of an idea and its scientific validity, argue that sociobiology fails on scientific grounds. Gould grouped sociobiology with eugenics, criticizing both in his book The Mismeasure of Man.

Noam Chomsky has expressed views on sociobiology on several occasions. During a 1976 meeting of the Sociobiology Study Group, as reported by Ullica Segerstråle, Chomsky argued for the importance of a sociobiologically informed notion of human nature. Chomsky argued that human beings are biological organisms and ought to be studied as such, with his criticism of the "blank slate" doctrine in the social sciences (which would inspire a great deal of Steven Pinker's and others' work in evolutionary psychology), in his 1975 Reflections on Language. Chomsky further hinted at the possible reconciliation of his anarchist political views and sociobiology in a discussion of Peter Kropotkin's Mutual Aid: A Factor of Evolution, which focused more on altruism than aggression, suggesting that anarchist societies were feasible because of an innate human tendency to cooperate.

Wilson has claimed that he had never meant to imply what ought to be, only what is the case. However, some critics have argued that the language of sociobiology readily slips from "is" to "ought", an instance of the naturalistic fallacy. Pinker has argued that opposition to stances considered anti-social, such as ethnic nepotism, is based on moral assumptions, meaning that such opposition is not falsifiable by scientific advances. The history of this debate, and others related to it, are covered in detail by Cronin (1993), Segerstråle (2000), and Alcock (2001).

Homosexual agenda (or gay agenda) is a term introduced by sectors of the Christian religious right (primarily in the United States) as a disparaging way to describe the advocacy of cultural acceptance and normalization of non-heterosexual orientations and relationships. The term refers to efforts to change government policies and laws on LGBT rights-related issues. Additionally, it has been used by social conservatives and others to describe alleged goals of LGBT rights activists, such as recruiting heterosexuals into what conservatives term a "homosexual lifestyle".

Origins and usage

Contemporary usage and meaning

The term is applied to efforts to change government policies and laws on lesbian, gay, bisexual, and transgender (LGBT) issues, for example, same-sex marriage and civil unions, LGBT adoption, recognizing sexual orientation as a protected civil rights minority classification, LGBT military participation, inclusion of LGBT history and themes in public education, introduction of anti-bullying legislation to protect LGBT minors—as well as non-governmental campaigns and individual actions that increase visibility and cultural acceptance of LGBT people, relationships, and identities. The term has also been used by some social conservatives to describe alleged goals of LGBT rights activists, such as supposed recruitment of heterosexuals into a "homosexual lifestyle".

A 1987 essay titled "The Overhauling of Straight America", by Marshall Kirk and Hunter Madsen (writing as Erastes Pill), lays out a six-point plan for a campaign, which was first published in Guide magazine. They argued that gays must portray themselves in a positive way to straight America, and that the main aim of making homosexuality acceptable could be achieved by getting Americans "to think that it is just another thing, with a shrug of their shoulders". Then "your battle for legal and social rights is virtually won". The pair developed their argument in the 1989 book After the Ball: How America Will Conquer Its Fear and Hatred of Gays in the '90s. The book outlined a public relations strategy for the LGBT movement. It argues that after the gay liberation phase of the 1970s and 1980s, gay rights groups should adopt more professional public relations techniques to convey their message. After its publication Kirk appeared in the pages of Newsweek, Time and The Washington Post. The book is often critically described by social conservatives such as Focus on the Family as important to the success of the LGBT Movement in the '90s and as part of an alleged "homosexual agenda".

Usage by religious critics

In the United States, the phrase "the gay agenda" was popularized by a video series produced by the evangelical religious group, Springs of Life Ministries in California, and distributed by many Christian right organizations, the first video of which was called The Gay Agenda and was released in 1992. In the same year the Oregon Citizens Alliance (OCA), a conservative Christian political activist organization, used this video as part of their campaign for Ballot Measure 9 to amend the Oregon Constitution to prevent what the OCA called special rights for gays, lesbians, and bisexuals.

Paul Cameron—co-founder of the Institute for the Scientific Investigation of Sexuality in Lincoln, later renamed the Family Research Institute—appeared in the video, wherein he asserted that 75 percent of gay men regularly ingest feces and that 70–78 percent have had a sexually transmitted disease. The Gay Agenda was followed by three other video publications; The Gay Agenda in Public Education (1993), The Gay Agenda: March on Washington (1993) and a feature follow-up Stonewall: 25 Years of Deception (1994). The videos contained interviews with opponents of LGBT rights, and the series was made available through Christian right organizations.

The idea of a homosexual agenda is also used by some Christian critics of LGBT rights in conjunction with a putative ideology they refer to as homosexualism (as opposed to a synonym for homosexuality), using homosexualists to describe people who seek to advance LGBT emancipation.

Other usages

In 2003, U.S. Supreme Court Justice Antonin Scalia wrote in his dissent in the landmark case Lawrence v. Texas that:

Today's opinion is the product of a Court, which is the product of a law-profession culture, that has largely signed on to the so-called homosexual agenda, by which I mean the agenda promoted by some homosexual activists directed at eliminating the moral opprobrium that has traditionally attached to homosexual conduct.

In 2004, Oklahoma Senator Tom Coburn rated the "gay agenda" as a more pressing danger than any terrorist activity affecting Americans.

In 2005, James Dobson, director of Focus on the Family, described the homosexual agenda as follows:

Those goals include universal acceptance of the gay lifestyle, discrediting of scriptures that condemn homosexuality, muzzling of the clergy and Christian media, granting of special privileges and rights in the law, overturning laws prohibiting pedophilia, indoctrinating children and future generations through public education, and securing all the legal benefits of marriage for any two or more people who claim to have homosexual tendencies.

In 2010, American conservative Christian group Family Research Council produced a graphic labelled "Homosexual Agenda" which consisted of the phrases "Innocence", "Family", "Local Community", "Public Health" and "Parental Authority" struck out with red lines.

In 2019 two prominent Roman Catholic cardinals - Raymond Leo Burke and Walter Brandmuller wrote an open letter to Pope Francis calling for an end of "the plague of the homosexual agenda" which they blamed for the sexual abuse crisis engulfing the Catholic Church. They claimed the agenda was spread by "organized networks" protected by a "conspiracy of silence".

Responses

The Gay & Lesbian Alliance Against Defamation (GLAAD) describes the term as a "rhetorical invention of anti-gay extremists seeking to create a climate of fear by portraying the pursuit of civil rights for LGBT people as sinister", and commentators have remarked on a lack of realism and veracity to the idea of a gay agenda per se. Such campaigns based on a presumed "gay agenda" have been described as anti-gay propaganda by researchers and critics. GLAAD describes the association of homosexuality with pedophilia or child abuse as an attempt to "insinuate that lesbians and gay men pose a threat to society, to families, and to children in particular." GLAAD considers assertions linking pedophilia and homosexuality to be defamatory, damaging and entirely inaccurate. Some writers have described the term as pejorative.

In a press conference on December 22, 2010, U.S. Representative Barney Frank said that the "gay agenda" is

to be protected against violent crimes driven by bigotry, it's to be able to get married, it's to be able to get a job, and it's to be able to fight for our country. For those who are worried about the radical homosexual agenda, let me put them on notice. Two down, two to go.

Satire

A satirical article by Michael Swift which appeared in the Gay Community News in February 1987 entitled "Gay Revolutionary" describes a scenario in which homosexual men dominate American society and suppress all things heterosexual. This was reprinted in Congressional Record without the opening line: "This essay is an outré, madness, a tragic, cruel fantasy, an eruption of inner rage, on how the oppressed desperately dream of being the oppressor."

The term is sometimes used satirically as a counterfoil by people who would normally find this term offensive, such as the spoof agenda found on the Betty Bowers satirical website, and when Bishop Gene Robinson declared that "Jesus is the agenda, the homosexual agenda in the Episcopal Church". On an episode of The Daily Show, Jon Stewart defined the gay agenda as "gay marriage, civil rights protection, Fleet Week expanded to Fleet Year, Federal Emergency Management Agency (FEMA) assistance for when it's raining men, Kathy Griffin to host everything and a nationwide ban on pleated pants".

Punishment, commonly, is the imposition of an undesirable or unpleasant outcome upon a group or individual, meted out by an authority—in contexts ranging from child discipline to criminal law—as a response and deterrent to a particular action or behavior that is deemed undesirable or unacceptable. It is, however, possible to distinguish between various different understandings of what punishment is.

The reasoning for punishment may be to condition a child to avoid self-endangerment, to impose social conformity (in particular, in the contexts of compulsory education or military discipline), to defend norms, to protect against future harms (in particular, those from violent crime), and to maintain the law—and respect for rule of law—under which the social group is governed. Punishment may be self-inflicted as with self-flagellation and mortification of the flesh in the religious setting, but is most often a form of social coercion.

The unpleasant imposition may include a fine, penalty, or confinement, or be the removal or denial of something pleasant or desirable. The individual may be a person, or even an animal. The authority may be either a group or a single person, and punishment may be carried out formally under a system of law or informally in other kinds of social settings such as within a family. Negative consequences that are not authorized or that are administered without a breach of rules are not considered to be punishment as defined here. The study and practice of the punishment of crimes, particularly as it applies to imprisonment, is called penology, or, often in modern texts, corrections; in this context, the punishment process is euphemistically called "correctional process". Research into punishment often includes similar research into prevention.

Justifications for punishment include retribution, deterrence, rehabilitation, and incapacitation. The last could include such measures as isolation, in order to prevent the wrongdoer's having contact with potential victims, or the removal of a hand in order to make theft more difficult.

If only some of the conditions included in the definition of punishment are present, descriptions other than "punishment" may be considered more accurate. Inflicting something negative, or unpleasant, on a person or animal, without authority is considered revenge or spite rather than punishment. In addition, the word "punishment" is used as a metaphor, as when a boxer experiences "punishment" during a fight. In other situations, breaking a rule may be rewarded, and so receiving such a reward naturally does not constitute punishment. Finally the condition of breaking (or breaching) the rules must be satisfied for consequences to be considered punishment.

Punishments differ in their degree of severity, and may include sanctions such as reprimands, deprivations of privileges or liberty, fines, incarcerations, ostracism, the infliction of pain, amputation and the death penalty. Corporal punishment refers to punishments in which physical pain is intended to be inflicted upon the transgressor. Punishments may be judged as fair or unfair in terms of their degree of reciprocity and proportionality to the offense. Punishment can be an integral part of socialization, and punishing unwanted behavior is often part of a system of pedagogy or behavioral modification which also includes rewards.

There are a large number of different understandings of what punishment is.

In philosophy

Various philosophers have presented definitions of punishment. Conditions commonly considered necessary properly to describe an action as punishment are that

  1. it is imposed by an authority,
  2. it involves some loss to the supposed offender,
  3. it is in response to an offense and
  4. the human (or other animal) to whom the loss is imposed should be deemed at least somewhat responsible for the offense.

In psychology

Introduced by B.F. Skinner, punishment has a more restrictive and technical definition. Along with reinforcement it belongs under the operant conditioning category. Operant conditioning refers to learning with either punishment (often confused as negative reinforcement) or a reward that serves as a positive reinforcement of the lesson to be learned. In psychology, punishment is the reduction of a behavior via application of an unpleasant stimulus ("positive punishment") or removal of a pleasant stimulus ("negative punishment"). Extra chores or spanking are examples of positive punishment, while removing an offending student's recess or play privileges are examples of negative punishment. The definition requires that punishment is only determined after the fact by the reduction in behavior; if the offending behavior of the subject does not decrease, it is not considered punishment. There is some conflation of punishment and aversives, though an aversion that does not decrease behavior is not considered punishment in psychology. Additionally, "aversive stimulus" is a label behaviorists generally apply to negative reinforcers (as in avoidance learning), rather than punishers.

In socio-biology

Punishment is sometimes called retaliatory or moralistic aggression; it has been observed in all species of social animals, leading evolutionary biologists to conclude that it is an evolutionarily stable strategy, selected because it favors cooperative behavior.

Examples against sociobiological use

One criticism of the claim of all social animals being evolutionarily hardwired for punishment comes from studies of animals, such as the octopuses near Capri, Italy that suddenly formed communal cultures from having, until then lived solitary lives. During a period of heavy fishing and tourism that encroached on their territory, they started to live in groups, learning from each other, especially hunting techniques. Small, younger octopuses could be near the fully grown octopuses without being eaten by them, even though they, like other Octopus vulgaris, were cannibals until just before the group formation. The authors stress that this behavior change happened too fast to be a genetic characteristic in the octopuses, and that there were certainly no mammals or other "naturally" social animals punishing octopuses for cannibalism involved. The authors also note that the octopuses adopted observational learning without any evolutionary history of specialized adaptation for it.

There are also arguments against the notion of punishment requiring intelligence, based on studies of punishment in very small-brained animals such as insects. There is proof of honey bee workers with mutations that makes them fertile laying eggs only when other honey bees are not observing them, and that the few that are caught in the act are killed. This is corroborated by computer simulations proving that a few simple reactions well within mainstream views of the extremely limited intelligence of insects are sufficient to emulate the "political" behavior observed in great apes. The authors argue that this falsifies the claim that punishment evolved as a strategy to deal with individuals capable of knowing what they are doing.

In the case of more complex brains, the notion of evolution selecting for specific punishment of intentionally chosen breaches of rules and/or wrongdoers capable of intentional choices (for example, punishing humans for murder while not punishing lethal viruses) is subject to criticism from coevolution issues. That punishment of individuals with certain characteristics (including but, in principle, not restricted to mental abilities) selects against those characteristics, making evolution of any mental abilities considered to be the basis for penal responsibility impossible in populations subject to such selective punishment. Certain scientists argue that this disproves the notion of humans having a biological feeling of intentional transgressions deserving to be punished.

Scope of application

Punishments are applied for various purposes, most generally, to encourage and enforce proper behavior as defined by society or family. Criminals are punished judicially, by fines, corporal punishment or custodial sentences such as prison; detainees risk further punishments for breaches of internal rules. Children, pupils and other trainees may be punished by their educators or instructors (mainly parents, guardians, or teachers, tutors and coaches).

Slaves, domestic and other servants are subject to punishment by their masters. Employees can still be subject to a contractual form of fine or demotion. Most hierarchical organizations, such as military and police forces, or even churches, still apply quite rigid internal discipline, even with a judicial system of their own (court martial, canonical courts).

Punishment may also be applied on moral, especially religious, grounds, as in penance (which is voluntary) or imposed in a theocracy with a religious police (as in a strict Islamic state like Iran or under the Taliban) or (though not a true theocracy) by Inquisition.

Hell as punishment

Belief that an individual's ultimate punishment is being sent by God, the highest authority, to an existence in Hell, a place believed to exist in the after-life, typically corresponds to sins committed during their life. Sometimes these distinctions are specific, with damned souls suffering for each sin committed (see for example Plato's myth of Er or Dante's The Divine Comedy), but sometimes they are general, with condemned sinners relegated to one or more chamber of Hell or to a level of suffering.

In many religious cultures, including Christianity and Islam, Hell is traditionally depicted as fiery and painful, inflicting guilt and suffering. Despite these common depictions of Hell as a place of fire, some other traditions portray Hell as cold. Buddhist – and particularly Tibetan Buddhist – descriptions of hell feature an equal number of hot and cold hells. Among Christian descriptions Dante's Inferno portrays the innermost (9th) circle of Hell as a frozen lake of blood and guilt. But cold also played a part in earlier Christian depictions of hell, beginning with the Apocalypse of Paul, originally from the early third century; the "Vision of Dryhthelm" by the Venerable Bede from the seventh century; "St Patrick's Purgatory", "The Vision of Tundale" or "Visio Tnugdali", and the "Vision of the Monk of Enysham", all from the twelfth century; and the "Vision of Thurkill" from the early thirteenth century.

History and rationale

Seriousness of a crime; Punishment fits the crime

A principle often mentioned with respect to the degree of punishment to be meted out is that the punishment should match the crime. One standard for measurement is the degree to which a crime affects others or society. Measurements of the degree of seriousness of a crime have been developed. A felony is generally considered to be a crime of "high seriousness", while a misdemeanor is not.

Possible reasons for punishment

There are many possible reasons that might be given to justify or explain why someone ought to be punished; here follows a broad outline of typical, possibly conflicting, justifications.

Deterrence (prevention)

Two reasons given to justify punishment is that it is a measure to prevent people from committing an offence - deterring previous offenders from re-offending, and preventing those who may be contemplating an offence they have not committed from actually committing it. This punishment is intended to be sufficient that people would choose not to commit the crime rather than experience the punishment. The aim is to deter everyone in the community from committing offences.

Some criminologists state that the number of people convicted for crime does not decrease as a result of more severe punishment and conclude that deterrence is ineffective. Other criminologists object to said conclusion, citing that while most people do not know the exact severity of punishment such as whether the sentence for murder is 40 years or life, most people still know the rough outlines such as the punishments for armed robbery or forcible rape being more severe than the punishments for driving too fast or misparking a car. These criminologists therefore argue that lack of deterring effect of increasing the sentences for already severely punished crimes say nothing about the significance of the existence of punishment as a deterring factor.

Some criminologists argue that increasing the sentences for crimes can cause criminal investigators to give higher priority to said crimes so that a higher percentage of those committing them are convicted for them, causing statistics to give a false appearance of such crimes increasing. These criminologists argue that the use of statistics to gauge the efficiency of crime fighting methods are a danger of creating a reward hack that makes the least efficient criminal justice systems appear to be best at fighting crime, and that the appearance of deterrence being ineffective may be an example of this.

Rehabilitation

Some punishment includes work to reform and rehabilitate the culprit so that they will not commit the offence again. This is distinguished from deterrence, in that the goal here is to change the offender's attitude to what they have done, and make them come to see that their behavior was wrong.

Incapacitation and societal protection

Incapacitation as a justification of punishment refers to the offender's ability to commit further offences being removed. Imprisonment separates offenders from the community, for example, Australia was a dumping ground for early British criminals. This was their way of removing or reducing the offenders ability to carry out certain crimes. The death penalty does this in a permanent (and irrevocable) way. In some societies, people who stole have been punished by having their hands amputated.

Retribution

Criminal activities typically give a benefit to the offender and a loss to the victim. Punishment has been justified as a measure of retributive justice, in which the goal is to try to rebalance any unjust advantage gained by ensuring that the offender also suffers a loss. Sometimes viewed as a way of "getting even" with a wrongdoer—the suffering of the wrongdoer is seen as a desired goal in itself, even if it has no restorative benefits for the victim. One reason societies have administered punishments is to diminish the perceived need for retaliatory "street justice", blood feud, and vigilantism.

Restoration

For minor offenses, punishment may take the form of the offender "righting the wrong", or making restitution to the victim. Community service or compensation orders are examples of this sort of penalty. In models of restorative justice, victims take an active role in a process with their offenders who are encouraged to take responsibility for their actions, "to repair the harm they've done – by apologizing, returning stolen money, or community service." The restorative justice approach aims to help the offender want to avoid future offences.

Education and denunciation

Punishment can be explained by positive prevention theory to use the criminal justice system to teach people what are the social norms for what is correct, and acts as a reinforcement.

Punishment can serve as a means for society to publicly express denunciation of an action as being criminal. Besides educating people regarding what is not acceptable behavior, it serves the dual function of preventing vigilante justice by acknowledging public anger, while concurrently deterring future criminal activity by stigmatizing the offender. This is sometimes called the "Expressive Theory" of denunciation. The pillory was a method for carrying out public denunciation.

Some critics of the education and denunciation model cite evolutionary problems with the notion that a feeling for punishment as a social signal system evolved if punishment was not effective. The critics argue that some individuals spending time and energy and taking risks in punishing others, and the possible loss of the punished group members, would have been selected against if punishment served no function other than signals that could evolve to work by less risky means.

Unified theory

A unified theory of punishment brings together multiple penal purposes—such as retribution, deterrence and rehabilitation—in a single, coherent framework. Instead of punishment requiring we choose between them, unified theorists argue that they work together as part of some wider goal such as the protection of rights.

Criticism

Some people think that punishment as a whole is unhelpful and even harmful to the people that it is used against. Detractors argue that punishment is simply wrong, of the same design as "two wrongs make a right". Critics argue that punishment is simply revenge. Professor Deirdre Golash, author of The Case against Punishment: Retribution, Crime Prevention, and the Law, says:

We ought not to impose such harm on anyone unless we have a very good reason for doing so. This remark may seem trivially true, but the history of humankind is littered with examples of the deliberate infliction of harm by well-intentioned persons in the vain pursuit of ends which that harm did not further, or in the successful pursuit of questionable ends. These benefactors of humanity sacrificed their fellows to appease mythical gods and tortured them to save their souls from a mythical hell, broke and bound the feet of children to promote their eventual marriageability, beat slow schoolchildren to promote learning and respect for teachers, subjected the sick to leeches to rid them of excess blood, and put suspects to the rack and the thumbscrew in the service of truth. They schooled themselves to feel no pity—to renounce human compassion in the service of a higher end. The deliberate doing of harm in the mistaken belief that it promotes some greater good is the essence of tragedy. We would do well to ask whether the goods we seek in harming offenders are worthwhile, and whether the means we choose will indeed secure them.

Golash also writes about imprisonment:

Imprisonment means, at minimum, the loss of liberty and autonomy, as well as many material comforts, personal security, and access to heterosexual relations. These deprivations, according to Gresham Sykes (who first identified them) “together dealt 'a profound hurt' that went to 'the very foundations of the prisoner's being. But these are only the minimum harms, suffered by the least vulnerable inmates in the best-run prisons. Most prisons are run badly, and in some, conditions are more squalid than in the worst of slums. In the District of Columbia jail, for example, inmates must wash their clothes and sheets in cell toilets because the laundry machines are broken. Vermin and insects infest the building, in which air vents are clogged with decades' accumulation of dust and grime. But even inmates in prisons where conditions are sanitary must still face the numbing boredom and emptiness of prison life—a vast desert of wasted days in which little in the way of meaningful activity is possible.

Destructiveness to thinking and betterment

There are critics of punishment who argue that punishment aimed at intentional actions forces people to suppress their ability to act on intent. Advocates of this viewpoint argue that such suppression of intention causes the harmful behaviors to remain, making punishment counterproductive. These people suggest that the ability to make intentional choices should instead be treasured as a source of possibilities of betterment, citing that complex cognition would have been an evolutionarily useless waste of energy if it led to justifications of fixed actions and no change as simple inability to understand arguments would have been the most thrifty protection from being misled by them if arguments were for social manipulation, and reject condemnation of people who intentionally did bad things. Punishment can be effective in stopping undesirable employee behaviors such as tardiness, absenteeism or substandard work performance. However, punishment does not necessarily cause an employee to demonstrate a desirable behavior.

Human Rights Watch (HRW) is an international non-governmental organization, headquartered in New York City, that conducts research and advocacy on human rights. The group pressures governments, policy makers, companies, and individual human rights abusers to denounce abuse and respect human rights, and the group often works on behalf of refugees, children, migrants, and political prisoners.

Human Rights Watch in 1997 shared in the Nobel Peace Prize as a founding member of the International Campaign to Ban Landmines and it played a leading role in the 2008 treaty banning cluster munitions.

The organization's annual expenses totaled $50.6 million in 2011, $69.2 million in 2014, and $75.5 million in 2017.

History

Human Rights Watch was co-founded by Robert L. Bernstein and Aryeh Neier as a private American NGO in 1978, under the name Helsinki Watch, to monitor the then-Soviet Union's compliance with the Helsinki Accords. Helsinki Watch adopted a practice of publicly "naming and shaming" abusive governments through media coverage and through direct exchanges with policymakers. By shining the international spotlight on human rights violations in the Soviet Union and its European partners, Helsinki Watch says it contributed to the democratic transformations of the region in the late 1980s.

Americas Watch was founded in 1981 while bloody civil wars engulfed Central America. Relying on extensive on-the-ground fact-finding, Americas Watch not only addressed perceived abuses by government forces but also applied international humanitarian law to investigate and expose war crimes by rebel groups. In addition to raising its concerns in the affected countries, Americas Watch also examined the role played by foreign governments, particularly the United States government, in providing military and political support to abusive regimes.

Asia Watch (1985), Africa Watch (1988), and Middle East Watch (1989) were added to what was known as "The Watch Committees". In 1988, all of these committees were united under one umbrella to form Human Rights Watch.

Profile

Pursuant to the Universal Declaration of Human Rights (UDHR), Human Rights Watch (HRW) opposes violations of what are considered basic human rights under the UDHR. This includes capital punishment and discrimination on the basis of sexual orientation. HRW advocates freedoms in connection with fundamental human rights, such as freedom of religion and freedom of the press. HRW seeks to achieve change by publicly pressuring governments and their policymakers to curb human rights abuses, and by convincing more powerful governments to use their influence on governments that violate human rights.

Human Rights Watch publishes research reports on violations of international human rights norms as set out by the Universal Declaration of Human Rights and what it perceives to be other internationally accepted, human-rights norms. These reports are used as the basis for drawing international attention to abuses and pressuring governments and international organizations to reform. Researchers conduct fact-finding missions to investigate suspect situations also using diplomacy, staying in touch with victims, making files about public and individuals, and providing required security for them in critical situations and in a proper time generate coverage in local and international media. Issues raised by Human Rights Watch in its reports include social and gender discrimination, torture, military use of children, political corruption, abuses in criminal justice systems, and the legalization of abortion. HRW has documented and reported various violations of the laws of war and international humanitarian law.

Human Rights Watch also supports writers worldwide, who are being persecuted for their work and are in need of financial assistance. The Hellman/Hammett grants are financed by the estate of the playwright Lillian Hellman in funds set up in her name and that of her long-time companion, the novelist Dashiell Hammett. In addition to providing financial assistance, the Hellman/Hammett grants help raise international awareness of activists who are being silenced for speaking out in defence of human rights.

Each year, Human Rights Watch presents the Human Rights Defenders Award to activists around the world who demonstrate leadership and courage in defending human rights. The award winners work closely with HRW in investigating and exposing human rights abuses.

Human Rights Watch was one of six international NGOs that founded the Coalition to Stop the Use of Child Soldiers in 1998. It is also the co-chair of the International Campaign to Ban Landmines, a global coalition of civil society groups that successfully lobbied to introduce the Ottawa Treaty, a treaty that prohibits the use of anti-personnel landmines.

Human Rights Watch is a founding member of the International Freedom of Expression Exchange, a global network of non-governmental organizations that monitor censorship worldwide. It also co-founded the Cluster Munition Coalition, which brought about an international convention banning the weapons. HRW employs more than 275 staff—country experts, lawyers, journalists, and academics – and operates in more than 90 countries around the world. Headquartered in New York City, it has offices in Amsterdam, Beirut, Berlin, Brussels, Chicago, Geneva, Johannesburg, London, Los Angeles, Moscow, Nairobi, Seoul, Paris, San Francisco, Sydney, Tokyo, Toronto, Washington, D.C., and Zürich. HRW maintains direct access to the majority of countries it reports on. Cuba, North Korea, Sudan, Iran, Israel, Egypt, the United Arab Emirates, Uzbekistan and Venezuela are among the handful of countries that have blocked access for HRW staff members.

The current executive director of HRW is Kenneth Roth, who has held the position since 1993. Roth conducted investigations on abuses in Poland after martial law was declared 1981. He later focused on Haiti, which had just emerged from the Duvalier dictatorship but continued to be plagued with problems. Roth's awareness of the importance of human rights began with stories his father had told about escaping Nazi Germany in 1938. Roth graduated from Yale Law School and Brown University.

Comparison with Amnesty International

Human Rights Watch and Amnesty International are the only two Western-oriented international human rights organizations operating in most situations of severe oppression or abuse worldwide. The major differences lie in the group's structure and methods for promoting change.

Amnesty International is a mass-membership organization. Mobilization of those members is the organization's central advocacy tool. Human Rights Watch's main products are its crisis-directed research and lengthy reports, whereas Amnesty International lobbies and writes detailed reports, but also focuses on mass letter-writing campaigns, adopting individuals as "prisoners of conscience" and lobbying for their release. Human Rights Watch will openly lobby for specific actions for other governments to take against human rights offenders, including naming specific individuals for arrest, or for sanctions to be levied against certain countries, recently calling for punitive sanctions against the top leaders in Sudan who have overseen a killing campaign in Darfur. The group has also called for human rights activists who have been detained in Sudan to be released.

Its documentations of human rights abuses often include extensive analyses of the political and historical backgrounds of the conflicts concerned, some of which have been published in academic journals. AI's reports, on the other hand, tend to contain lesser analyses, and instead focus on specific abuses of rights.

In 2010, The Times of London wrote that HRW has "all but eclipsed" Amnesty International. According to The Times, instead of being supported by a mass membership, as AI is, HRW depends on wealthy donors who like to see the organization's reports make headlines. For this reason, according to The Times, HRW tends to "concentrate too much on places that the media already cares about", especially in disproportionate coverage of Israel.

Financing and services

For the financial year ending June 2008, HRW reported receiving approximately US$44 million in public donations. In 2009, Human Rights Watch stated that they receive almost 75% of their financial support from North America, 25% from Western Europe and less than 1% from the rest of the world.

According to a 2008 financial assessment, HRW reports that it does not accept any direct or indirect funding from governments and is financed through contributions from private individuals and foundations.

Financier and philanthropist George Soros of the Open Society Foundation announced in 2010 his intention to grant US$100 million to HRW over a period of ten years to help it expand its efforts internationally: "to be more effective," he said, "I think the organization has to be seen as more international, less an American organization." He said, "Human Rights Watch is one of the most effective organizations I support. Human rights underpin our greatest aspirations: they're at the heart of open societies." The donation increases Human Rights Watch's operating staff of 300 by 120 people. The donation was the largest in the organization's history.

Charity Navigator gave Human Rights Watch a three-star rating overall for 2018. Its financial rating increased from three stars in 2015 to the maximum four as of June 2016. The Better Business Bureau said Human Rights Watch meets its standards for charity accountability.

Publications

Human Rights Watch publishes reports on many different topics and compiles an annual World Report presenting an overview of the worldwide state of human rights. It has been published by Seven Stories Press since 2006; the current edition, World Report 2020, was released in January 2020, and covers events of 2019. World Report 2020, HRW's 30th annual review of human rights practices around the globe, includes reviews of human rights practices and trends in nearly 100 countries, and an introductory essay by HRW Executive Director Kenneth Roth "China’s Global Threat to Human Rights". Human Rights Watch has reported extensively on subjects such as the Rwandan genocide of 1994, Democratic Republic of the Congo and US sex offender registries due to their over-breadth and application to juveniles.

In the summer of 2004, the Rare Book and Manuscript Library at Columbia University in New York became the depository institution for the Human Rights Watch Archive, an active collection that documents decades of human rights investigations around the world. The archive was transferred from its previous location at the Norlin Library at the University of Colorado, Boulder. The archive includes administrative files, public relations documents, as well as case and country files. With some exceptions for security considerations, the Columbia University community and the public have access to field notes, taped and transcribed interviews with alleged victims of human rights violations, video and audiotapes, and other materials documenting the organization's activities since its founding in 1978 as Helsinki Watch. However, significant parts of the HRW archive are not open to researchers or to the public, including the records of the meetings of the board of directors, the executive committee, and the various subcommittees, limiting historians' ability to understand the organization's internal decision-making.

Criticism

HRW has been criticized for perceived bias by the national governments it has investigated for human rights abuses, by NGO Monitor, and by HRW's founder, and former Chairman, Robert L. Bernstein. Bias allegations have included undue influence by United States government policy, claims that HRW is biased against Israel (and focuses undue attention on the Arab–Israeli conflict). HRW has also been criticized for poor research methodology and lax fact-checking, and ignoring the human-rights abuses of less-open regimes. HRW has routinely publicly addressed, and often denies, criticism of its reporting and findings.

According to Democracy Now, HRW has also been criticized for having a 'revolving door' with the U.S. government, a charge which HRW disputes.

In 2020, the HRW Board of Directors discovered that Human Rights Watch accepted a $470,000 donation from Saudi real estate magnate Mohamed Bin Issa Al Jaber, owner of a company HRW "had previously identified as complicit in labor rights abuse", under the condition that the donation not be used to support LGBT advocacy in the Middle East and North Africa. The gift was returned and Human Rights Watch issued a statement saying that accepting the funding was a “deeply regrettable decision” in response to investigative reporting from The Intercept regarding the donation.

In August 2020, HRW executive director Kenneth Roth was sanctioned – together with the heads of four other U.S.-based democracy and human rights organizations and six U.S. Republican lawmakers – by the Chinese government for supporting the Hong Kong pro-democracy movement in the 2019–20 Hong Kong protests. The leaders of the five organizations saw the sanctioning, whose details were unspecified, as a tit-for-tat measure in response to the earlier sanctioning by the U.S. of 11 Hong Kong officials. The latter step had in turn been a reaction to the enactment of the Hong Kong National Security Law at the end of June.
