Amazon.com, Inc., doing business as Amazon (/ˈæməˌzɒn/), is an American electronic commerce and cloud computing company based in Seattle, Washington that was founded by Jeff Bezos on July 5, 1994. The tech giant is the largest Internet retailer in the world as measured by revenue and market capitalization, and second largest after Alibaba Group in terms of total sales.[3] The amazon.com website started as an online bookstore and later diversified to sell video downloads/streaming, MP3 downloads/streaming, audiobook downloads/streaming, software, video games, electronics, apparel, furniture, food, toys, and jewelry. The company also produces consumer electronicsKindle e-readers, Fire tablets, Fire TV, and Echo—and is the world's largest provider of cloud infrastructure services (IaaS and PaaS).[4] Amazon also sells certain low-end products under its in-house brand AmazonBasics.

Amazon has separate retail websites for the United States, the United Kingdom and Ireland, France, Canada, Germany, Italy, Spain, Netherlands, Australia, Brazil, Japan, China, India, and Mexico. In 2016, Dutch, Polish, and Turkish language versions of the German Amazon website were also launched.[5][6][7] Amazon also offers international shipping of some of its products to certain other countries.[8]

In 2015, Amazon surpassed Walmart as the most valuable retailer in the United States by market capitalization.[9] Amazon is the fourth most valuable public company in the world (behind only Apple, Alphabet, and Microsoft), the largest Internet company by revenue in the world, and after Walmart, the second largest employer in the United States.[10] In 2017, Amazon acquired Whole Foods Market for $13.4 billion, which vastly increased Amazon's presence as a brick-and-mortar retailer.[11] The acquisition was interpreted by some as a direct attempt to challenge Walmart's traditional retail stores.[12] In 2018, for the first time, Jeff Bezos released in Amazon's shareholder letter the number of Amazon Prime subscribers, which at 100 million, is approximately 64% of the population of the United States.[13][14]

History

The company was founded as a result of what Jeff Bezos called his "regret minimization framework," which described his efforts to fend off any regrets for not participating sooner in the Internet business boom during that time.[15] In 1994, Bezos left his employment as vice-president of D. E. Shaw & Co., a Wall Street firm, and moved to Seattle, Washington. He began to work on a business plan[16] for what would eventually become Amazon.com.

On July 5, 1994, Bezos initially incorporated the company in Washington State with the name Cadabra, Inc.[17] Bezos changed the name to Amazon.com, Inc. a few months later, after a lawyer misheard its original name as "cadaver".[18] In September 1994, Bezos purchased the URL Relentless.com and briefly considered naming his online store Relentless, but friends told him the name sounded a bit sinister. The domain is still owned by Bezos and still redirects to the retailer.[19][20] The company went online as Amazon.com in 1995.[21]

Bezos selected the name Amazon by looking through the dictionary; he settled on "Amazon" because it was a place that was "exotic and different", just as he had envisioned for his Internet enterprise. The Amazon River, he noted, was the biggest river in the world, and he planned to make his store the biggest bookstore in the world.[21] Bezos placed a premium on his head start in building a brand and told a reporter, "There's nothing about our model that can't be copied over time. But you know, McDonald's got copied. And it still built a huge, multibillion-dollar company. A lot of it comes down to the brand name. Brand names are more important online than they are in the physical world."[22] Additionally, a name that began with "A" was preferential due to the probability it would occur at the top of any list that was alphabetized.[citation needed]

After reading a report about the future of the Internet that projected annual Web commerce growth at 2,300%, Bezos created a list of 20 products that could be marketed online. He narrowed the list to what he felt were the five most promising products, which included: compact discs, computer hardware, computer software, videos, and books. Bezos finally decided that his new business would sell books online, due to the large worldwide demand for literature, the low price points for books, along with the huge number of titles available in print.[23] Amazon was founded in the garage of Bezos' home in Bellevue, Washington.[24]

In July 1995, the company began service as an online bookstore.[25] The first book sold on Amazon.com was Douglas Hofstadter's Fluid Concepts and Creative Analogies: Computer Models of the Fundamental Mechanisms of Thought.[26] In the first two months of business, Amazon sold to all 50 states and over 45 countries. Within two months, Amazon's sales were up to $20,000/week.[27] While the largest brick and mortar bookstores might offer 150,000 titles, an online bookstore could offer several times more, since online it could have a universal selection of every book printed.[28]

In October 1995, the company announced itself to the public.[29] In 1996, it was reincorporated in Delaware. Amazon issued its initial public offering of stock on May 15, 1997, trading under the NASDAQ stock exchange symbol AMZN, at a price of US$18.00 per share ($1.50 after three stock splits in the late 1990s).[citation needed]

Barnes & Noble sued Amazon on May 12, 1997, alleging that Amazon's claim to be "the world's largest bookstore" was false because it "...isn't a bookstore at all. It's a book broker." The suit was later settled out of court and Amazon continued to make the same claim.[30] Walmart sued Amazon on October 16, 1998, alleging that Amazon had stolen Walmart's trade secrets by hiring former Walmart executives. Although this suit was also settled out of court, it caused Amazon to implement internal restrictions and the reassignment of the former Walmart executives.[30]

In 1999, Amazon first attempted to enter the publishing business by buying a defunct imprint, "Weathervane", and publishing some books "selected with no apparent thought", according to The New Yorker. The imprint quickly vanished again, and as of 2014 Amazon representatives said that they had never heard of it.[31]

Since June 19, 2000, Amazon's logotype has featured a curved arrow leading from A to Z, representing that the company carries every product from A to Z, with the arrow shaped like a smile.[32]

Amazon's initial business plan was unusual; it did not expect to make a profit for four to five years. This "slow" growth caused stockholders to complain that the company was not reaching profitability fast enough to justify their investment or even survive in the long-term. The dot-com bubble burst at the start of the 21st century and destroyed many e-companies in the process, but Amazon survived and moved forward beyond the tech crash to become a huge player in online sales. The company finally turned its first profit in the fourth quarter of 2001: $5 million (i.e., 1¢ per share), on revenues of more than $1 billion. This profit margin, though extremely modest, proved to skeptics that Bezos' unconventional business model could succeed.[33] In 1999, Time magazine named Bezos the Person of the Year when it recognized the company's success in popularizing online shopping.[citation needed]

In 2011, Amazon had 30,000 full-time employees in the USA, and by the end of 2016, it had 180,000 employees. The company employs 306,800 people worldwide in full and part-time jobs.[34]

On October 11, 2016, Amazon announced plans to build convenience stores and develop curbside pickup locations for food.[35] In December 2016, the Amazon Go store was opened to Amazon employees in Seattle.[36] The store uses a variety of cameras and sensors with the help of computer vision to detect items that a shopper grabs off shelves, automatically charging a shopper's Amazon account as they walk out of the store, thus eliminating the need for checkout lines.[37][38][39] The store was planned to open for the general public in early 2017, but was delayed.[40][41] On January 22, 2018, Amazon opened its Amazon Go store in Seattle to the general public.[42][43] Customers scan their Amazon Go app as they enter, and are required to have an Amazon Go app installed on their smartphone and a linked Amazon account to be able to enter.[42][39]

In June 2017, Amazon announced that it would acquire Whole Foods, a high-end supermarket chain with over 400 stores, for $13.4 billion.[11][44] The acquisition was seen by media experts as a move to strengthen its physical holdings and challenge Walmart's supremacy as a brick and mortar retailer. This sentiment was heightened by the fact that the announcement coincided with Walmart's purchase of men's apparel company Bonobos.[45] On August 23, 2017, Whole Foods shareholders, as well as the Federal Trade Commission, approved the deal.[46][47]

In September 2017, Amazon announced plans to locate a second headquarters in a metropolitan area with at least a million people.[48] Cities needed to submit their presentations by October 19, 2017 for the project called HQ2.[49] The $5 billion second headquarters, starting with 500,000 square feet and eventually expanding to as much as 8 million square feet, may have as many as 50,000 employees.[50]

In 2020, Amazon will build a new downtown Seattle building with space for Mary's Place, a local charity.[51] In May 2018, Amazon announced that it has paused construction planning on new downtown Seattle tower over the proposal to tax large employers.[52]

Merchant partnerships

Until June 30, 2006, typing ToysRUs.com into a browser would bring up Amazon.com's "Toys & Games" tab; however, this relationship was terminated due to a lawsuit.[70] Amazon also hosted and managed the website for Borders bookstores but this ceased in 2008.[71] From 2001 until August 2011, Amazon hosted the retail website for Target.[72]

Amazon.com operates retail websites for Sears Canada, Bebe Stores, Marks & Spencer, Mothercare, and Lacoste. For a growing number of enterprise clients, including the UK merchants Marks & Spencer, Benefit Cosmetics' UK entity, edeals.com and Mothercare, Amazon provides a unified multichannel platform where a customer can interact with the retail website, standalone in-store terminals or phone-based customer service agents. Amazon Web Services also powers AOL's Shop@AOL.[citation needed]

On October 18, 2011, Amazon.com announced a partnership with DC Comics for the exclusive digital rights to many popular comics, including Superman, Batman, Green Lantern, The Sandman, and Watchmen. The partnership has caused well-known bookstores like Barnes & Noble to remove these titles from their shelves.[73]

In November 2013, Amazon.com announced a partnership with the United States Postal Service to begin delivering orders on Sundays. The service, included in Amazon's standard shipping rates, initiated in metropolitan areas of Los Angeles and New York due to the high-volume and inability to deliver timely, with plans to expand into Dallas, Houston, New Orleans and Phoenix by 2014.[74]

In July 2016, Amazon.com announced a partnership with the U.K. Civil Aviation Authority to test some of the technologies and may use delivery service via prime air drone in the future.[75]

In June 2017, Nike confirmed a partnership with Amazon, stating it to be in an initial phase where they'll be selling goods on Amazon.[76][77][78]

As of October 11, 2017, AmazonFresh sells a range of Booths branded products for home delivery in selected areas.[79]

Amazon Maritime

Amazon Maritime, Inc. holds a Federal Maritime Commission license to operate as a non-vessel-owning common carrier (NVOCC), which enables the company to manage its own shipments from China into the United States.[81]

Audible.com

Audible.com is a seller and producer of spoken audio entertainment, information and educational programming on the Internet. Audible sells digital audiobooks, radio and TV programs and audio versions of magazines and newspapers. Through its production arm, Audible Studios, Audible has also become the world's largest producer of downloadable audiobooks. On January 31, 2008, Amazon announced it would buy Audible for about $300 million. The deal closed in March 2008 and Audible became a subsidiary of Amazon.[82]

Beijing Century Joyo Courier Services is a subsidiary of Amazon and it applied for a freight forwarding license with the US Maritime Commission. Amazon is also building out its logistics in trucking and air freight to potentially compete with UPS and FedEx.[83][84]

Brilliance Audio

Brilliance Audio is an audiobook publisher founded in 1984 by Michael Snodgrass in Grand Haven, Michigan.[85] The company produced its first 8 audio titles in 1985.[85] The company was purchased by Amazon in 2007 for an undisclosed amount.[86][87] At the time of the acquisition, Brilliance was producing 12–15 new titles a month.[87] It operates as an independent company within Amazon.

In 1984, Brilliance Audio invented a technique for recording twice as much on the same cassette.[88] The technique involved recording on each of the two channels of each stereo track.[88] It has been credited with revolutionizing the burgeoning audiobook market in the mid-1980s since it made unabridged books affordable.[88]

ComiXology

ComiXology is a cloud-based digital comics platform with over 200 million comic downloads as of September 2013. It offers a selection of more than 40,000 comic books and graphic novels across Android, iOS, Fire OS and Windows 8 devices and over a web browser. Amazon bought the company in April 2014.[89]

Goodreads

Goodreads is a "social cataloging" website founded in December 2006 and launched in January 2007 by Otis Chandler, a software engineer, and entrepreneur, and Elizabeth Chandler. The website allows individuals to freely search Goodreads' extensive user-populated database of books, annotations, and reviews. Users can sign up and register books to generate library catalogs and reading lists. They can also create their own groups of book suggestions and discussions. In December 2007, the site had over 650,000 members and over 10 million books had been added. Amazon bought the company in March 2013.[90]

Shelfari

Shelfari was a social cataloging website for books. Shelfari users built virtual bookshelves of the titles which they owned or had read and they could rate, review, tag and discuss their books. Users could also create groups that other members could join, create discussions and talk about books, or other topics. Recommendations could be sent to friends on the site for what books to read. Amazon bought the company in August 2008.[90] Shelfari continued to function as an independent book social network within the Amazon until January 2016, when Amazon announced that it would be merging Shelfari with Goodreads and closing down Shelfari.[91][92]

Twitch

Twitch is a live streaming platform for video, primarily oriented towards video gaming content. The service was first established as a spin-off of a general-interest streaming service known as Justin.tv. Its prominence was eclipsed by that of Twitch, and Justin.tv was eventually shut down by its parent company in August 2014 in order to focus exclusively on Twitch.[93] Later that month, Twitch was acquired by Amazon for $970 million.[94] Through Twitch, Amazon also owns Curse, Inc., an operator of video gaming communities and a provider of VoIP services for gaming.[95] Since the acquisition, Twitch began to sell games directly through the platform,[96] and began offering special features for Amazon Prime subscribers.[97]

The site's rapid growth had been boosted primarily by the prominence of major esports competitions on the service, leading GameSpot senior esports editor Rod Breslau to have described the service as "the ESPN of esports".[98] As of 2015, the service had over 1.5 million broadcasters and 100 million monthly viewers.[99]

Whole Foods Market

Whole Foods Market is an American supermarket chain exclusively featuring foods without artificial preservatives, colors, flavors, sweeteners, and hydrogenated fats.[100]

On August 23, 2017, it was reported that the Federal Trade Commission approved the merger between Amazon.com and Whole Foods Market.[101] The following day it was announced that the deal would be closed on August 28, 2017.[102]

Junglee

Junglee is a former online shopping service which was provided by Amazon which enabled customers to search for products from online and offline retailers in India. Junglee started off as a virtual database that was used to extract information off the internet and deliver it to enterprise applications. As it progressed, Junglee started to use its database technology to create a single window marketplace on the internet by making every item from every supplier available for purchase. Web shoppers could locate, compare and transact millions of products from across the Internet shopping mall through one window.[103]

Amazon acquired Junglee in 1998, and the website Junglee.com was launched in India in February 2012[104] as a comparison-shopping website. It curated and enabled searching for a diverse variety of products such as clothing, electronics, toys, jewellery and video games, among others, across thousands of online and offline sellers. Millions of products are browse-able, whereby the client selects a price, and then they are directed to a seller. In November 2017, Amazon closed down Junglee.com and the former domain currently redirects to Amazon India.[105]

The domain amazon.com attracted at least 615 million visitors annually by 2008.[108] Amazon attracts over 130 million customers to its US website per month by the start of 2016.[109] The company has also invested heavily on a massive amount of server capacity for its website, especially to handle the excessive traffic during the December Christmas holiday season.[110]

Results generated by Amazon's search engine are partly determined by promotional fees.[111]

Reviews

Amazon allows users to submit reviews to the web page of each product. Reviewers must rate the product on a rating scale from one to five stars. Amazon provides a badging option for reviewers which indicate the real name of the reviewer (based on confirmation of a credit card account) or which indicate that the reviewer is one of the top reviewers by popularity. Customers may comment or vote on the reviews, indicating whether they found a review helpful to them. If a review is given enough "helpful" hits, it appears on the front page of the product. In 2010, Amazon was reported as being the largest single source of Internet consumer reviews.[112]

When publishers asked Bezos why Amazon would publish negative reviews, he defended the practice by claiming that Amazon.com was "taking a different approach ... we want to make every book available—the good, the bad and the ugly ... to let truth loose".[113]

There have been cases of positive reviews being written and posted by public relations companies on behalf of their clients[114] and instances of writers using pseudonyms to leave negative reviews of their rivals' works.

Content search

"Search Inside the Book" is a feature which allows customers to search for keywords in the full text of many books in the catalog.[115][116] The feature started with 120,000 titles (or 33 million pages of text) on October 23, 2003.[117] There are about 300,000 books in the program. Amazon has cooperated with around 130 publishers to allow users to perform these searches.[citation needed]

To avoid copyright violations, Amazon does not return the computer-readable text of the book. Instead, it returns a picture of the matching page, instructs the web browser to disable printing and puts limits on the number of pages in a book a single user can access. Additionally, customers can purchase online access to some of the same books via the "Amazon Upgrade" program.[citation needed]

Third-party sellers

Amazon derives many of its sales (around 40% in 2008) from third-party sellers who sell products on Amazon.[118] Associates receive a commission for referring customers to Amazon by placing links to Amazon on their websites if the referral results in a sale. Worldwide, Amazon has "over 900,000 members" in its affiliate programs.[119] In the middle of 2014, the Amazon Affiliate Program is used by 1.2% of all websites and it is the second most popular advertising network after Google Ads.[120] It is frequently used by websites and non-profits to provide a way for supporters to earn them a commission.[121] Amazon reported over 1.3 million sellers sold products through Amazon's websites in 2007. Unlike eBay, Amazon sellers do not have to maintain separate payment accounts; all payments are handled by Amazon.[citation needed]

Associates can access the Amazon catalog directly on their websites by using the Amazon Web Services (AWS) XML service. A new affiliate product, aStore, allows Associates to embed a subset of Amazon products within another website, or linked to another website. In June 2010, Amazon Seller Product Suggestions was launched (rumored to be internally called "Project Genesis") to provide more transparency to sellers by recommending specific products to third-party sellers to sell on Amazon. Products suggested are based on customers' browsing history.[122]

Amazon sales rank

The Amazon sales rank (ASR) provides an indication of the popularity of a product sold on any Amazon locale. It is a relative indicator of popularity that is updated hourly. Effectively, it is a "best sellers list" for the millions of products stocked by Amazon.[123] While the ASR has no direct effect on the sales of a product, it is used by Amazon to determine which products to include in its best-sellers lists.[123] Products that appear in these lists enjoy additional exposure on the Amazon website and this may lead to an increase in sales. In particular, products that experience large jumps (up or down) in their sales ranks may be included within Amazon's lists of "movers and shakers"; such a listing provides additional exposure that might lead to an increase in sales.[124] For competitive reasons, Amazon does not release actual sales figures to the public. However, Amazon has now begun to release point of sale data via the Nielsen BookScan service to verified authors.[125] While the ASR has been the source of much speculation by publishers, manufacturers, and marketers, Amazon itself does not release the details of its sales rank calculation algorithm. Some companies have analyzed Amazon sales data to generate sales estimates based on the ASR,[126] though Amazon states:

Technology

Amazon runs data centers for its online services and owns generators or purchases electricity corresponding to its consumption, mostly renewable energy.[128] Amazon contracted with Avangrid to build and operate the first wind farm in North Carolina to power Amazon's Virginia data centers. The wind farm was built and began operating in December 2016 despite opposition from President Trump and some North Carolina Republican legislators.[129][130][131][132][133]

Amazon records data on customer buyer behavior which enables them to offer or recommend to an individual specific item or bundles of items based upon preferences demonstrated through purchases or items visited.[134][better source needed]

On May 5, 2014, Amazon unveiled a partnership with Twitter. Twitter users can link their accounts to an Amazon account and automatically add items to their shopping carts by responding to any tweet with an Amazon product link bearing the hashtag #AmazonCart. This allows customers to never leave their Twitter feed and the product is waiting for them when they go to the Amazon website.[135]

Multi-level sales strategy

Amazon employs a multi-level e-commerce strategy. Amazon started by focusing on business-to-consumer relationships between itself and its customers and business-to-business relationships between itself and its suppliers and then moved to facilitate customer-to-customer with the Amazon marketplace which acts as an intermediary to facilitate transactions. The company lets anyone sell nearly anything using its platform. In addition to an affiliate program that lets anyone post-Amazon links and earn a commission on click-through sales, there is now a program which lets those affiliates build entire websites based on Amazon's platform.[136]

Some other large e-commerce sellers use Amazon to sell their products in addition to selling them through their own websites. The sales are processed through Amazon.com and end up at individual sellers for processing and order fulfillment and Amazon leases space for these retailers. Small sellers of used and new goods go to Amazon Marketplace to offer goods at a fixed price.[137] Amazon also employs the use of drop shippers or meta sellers. These are members or entities that advertise goods on Amazon who order these goods direct from other competing websites but usually from other Amazon members. These meta sellers may have millions of products listed, have large transaction numbers and are grouped alongside other less prolific members giving them credibility as just someone who has been in business for a long time. Markup is anywhere from 50% to 100% and sometimes more, these sellers maintain that items are in stock when the opposite is true. As Amazon increases their dominance in the marketplace these drop shippers have become more and more commonplace in recent years.[citation needed]

In November 2015, Amazon opened its first physical bookstore location. It is named Amazon Books and is located in University Village in Seattle. The store is 5,500 square feet and prices for all products match those on its website.[138] Amazon will open its tenth physical book store in 2017;[139] media speculation suggests Amazon plans to eventually roll out 300 to 400 bookstores around the country.[138] Amazon plans to open brick and mortar bookstores in Germany.[140]

Revenue

Amazon.com is primarily a retail site with a sales revenue model; Amazon takes a small percentage of the sale price of each item that is sold through its website while also allowing companies to advertise their products by paying to be listed as featured products.[141]

Controversies

Since its founding, the company has attracted criticism and controversy from multiple sources over its actions. These include: luring customers away from the site's brick and mortar competitors,[142] poor warehouse conditions for workers; anti-unionization efforts; Amazon Kindle remote content removal; taking public subsidies; its "1-Click patent" claims; anti-competitive actions;[143] price discrimination; various decisions over whether to censor or publish content such as the WikiLeaks website; LGBT book sales rank;[144][145] and works containing libel, facilitating dogfight, cockfight, or pedophile activities. In December 2011, Amazon faced a backlash from small businesses for running a one-day deal to promote its new Price Check app. Shoppers who used the app to check prices in a brick-and-mortar store were offered a 5% discount to purchase the same item from Amazon.[146] Companies like Groupon, eBay and Taap.it countered Amazon's promotion by offering $10 off from their products.[147][148] The company has also faced accusations of putting undue pressure on suppliers to maintain and extend its profitability. One effort to squeeze the most vulnerable book publishers was known within the company as the Gazelle Project, after Bezos suggested, according to Brad Stone, "that Amazon should approach these small publishers the way a cheetah would pursue a sickly gazelle."[111] In July 2014, the Federal Trade Commission launched a lawsuit against the company alleging it was promoting in-app purchases to children, which were being transacted without parental consent.[149][150]

Selling counterfeit items

On October 16, 2016, Apple filed a trademark infringement case against Mobile Star LLC for selling counterfeit Apple products to Amazon. In the suit, Apple provided evidence that Amazon was selling these counterfeit Apple products and advertising them as genuine. Through purchasing, Apple was able to identify that nearly 90% of the Apple accessories sold and fulfilled by Amazon were counterfeit. Amazon was sourcing and selling items without properly determining if they are genuine. Mobile Star LLC settled with Apple for an undisclosed amount on April 27, 2017.[151]

Sales and use taxes

Amazon state sales tax collection policy has changed over the years since in the company's beginning it did not collect any sale taxes. In the U.S., state and local sales taxes are levied by state and local governments, not at the federal level. In most countries where Amazon operates, a sales tax or value added tax is uniform throughout the country, and Amazon is obliged to collect it from all customers. Proponents of forcing Amazon.com to collect sales tax—at least in states where it maintains a physical presence—argue the corporation wields an anti-competitive advantage over storefront businesses forced to collect sales tax.[152]

Many U.S. states in the 21st century have passed online shopping sales tax laws designed to compel Amazon.com and other e-commerce retailers to collect state and local sales taxes from its customers. Amazon.com originally collected sales tax only from five states as of 2011, but as of April 2017, Amazon collects sales taxes from customers in all 45 states that have a state sales tax and in Washington, D.C.[153]

Comments by President Trump

In 2018, President Donald Trump repeatedly criticized Amazon's use of the United States Postal Service and pricing of its deliveries, stating, "I am right about Amazon costing the United States Post Office massive amounts of money for being their Delivery Boy," Trump tweeted. "Amazon should pay these costs (plus) and not have them bourne [sic] by the American Taxpayer."[154] Amazon's shares fell as much as 6 percent on Trump's comments although no actual facts were presented supporting the President's claims.[155][156]

Poor working conditions

Amazon has attracted widespread criticism for poor working conditions by both current employees, which refer to themselves as Amazonians,[157] and former employees,[158][159] as well as the media and politicians. In 2011, it was publicized that at the Breinigsville, Pennsylvania warehouse, workers had to carry out work in 100 °F (38 °C) heat, resulting in employees becoming extremely uncomfortable and suffering from dehydration and collapse. Loading-bay doors were not opened to allow in fresh air, due to the company's concerns over theft.[160] Amazon's initial response was to pay for an ambulance to sit outside on call to cart away overheated employees.[160] The company eventually installed air conditioning at the warehouse.[161]

Some workers, "pickers", who travel the building with a trolley and a handheld scanner "picking" customer orders can walk up to 15 miles during their workday and if they fall behind on their targets, they can be reprimanded. The handheld scanners give real-time information to the employee on how fast or slowly they are working; the scanners also serve to allow Team Leads and Area Managers to track the specific locations of employees and how much "idle time" they gain when not working.[162][163] In a German television report broadcast in February 2013, journalists Diana Löbl and Peter Onneken conducted a covert investigation at the distribution center of Amazon in the town of Bad Hersfeld in the German state of Hessen. The report highlights the behavior of some of the security guards, themselves being employed by a third party company, who apparently either had a Neo-nazi background or deliberately dressed in Neo-Nazi apparel and who were intimidating foreign and temporary female workers at its distribution centers. The third party security company involved was delisted by Amazon as a business contact shortly after that report.[164][165][166][167][168]

In March 2015, it was reported in The Verge that Amazon will be removing 18 months long non-compete clauses from its US employment contracts for hourly-paid workers, after criticism that it was acting unreasonably in preventing such employees from finding other work. Even short-term temporary workers have to sign contracts that prohibit them from working at any company where they would "directly or indirectly" support any good or service that competes with those they helped support at Amazon, for 18 months after leaving Amazon, even if they are fired or made redundant.[169][170]

A substantial New York Times article published on August 16, 2015, described evidence of an intimidating and confrontational working culture for the company's office workers.[9]

In an effort to boost employee morale, on November 2, 2015, Amazon announced that it would be extending 6 weeks of paid leave for new mothers and fathers. This change includes birth parents and adoptive parents and can be applied in conjunction with existing maternity leave and medical leave for new mothers.[171]

Conflict of interest

In 2013, Amazon secured a 600 million dollar contract with the CIA, which poses a potential conflict of interest involving the Bezos-owned Washington Post and his newspaper's coverage of the CIA.[172] Kate Martin, director of the Center for National Security Studies, said, "It's a serious potential conflict of interest for a major newspaper like The Washington Post to have a contractual relationship with the government and the most secret part of the government."[173]

Lobbying

Amazon lobbies the United States federal government and state governments on issues such as the enforcement of sales taxes on online sales, transportation safety, privacy and data protection and intellectual property. According to regulatory filings, Amazon.com focuses its lobbying on the United States Congress, the Federal Communications Commission and the Federal Reserve. Amazon.com spent roughly $3.5 million, $5 million and $9.5 million on lobbying, in 2013, 2014 and 2015, respectively.[174]

Amazon.com was a corporate member of the American Legislative Exchange Council (ALEC) until it dropped membership following protests at its shareholders' meeting on May 24, 2012.[175]

In 2014, Amazon expanded its lobbying practices as it prepared to lobby the Federal Aviation Administration to approve its drone delivery program, hiring the Akin Gump Strauss Hauer & Feld lobbying firm in June.[176] Amazon and its lobbyists have visited with Federal Aviation Administration officials and aviation committees in Washington, D.C. to explain its plans to deliver packages.[177]

A computer hacker is any skilled computer expert that uses their technical knowledge to overcome a problem. While "hacker" can refer to any skilled computer programmer, the term has become associated in popular culture with a "security hacker", someone who, with their technical knowledge, uses bugs or exploits to break into computer systems.

Definitions

Reflecting the two types of hackers, there are two definitions of the word "hacker":
  1. an adherent of the technology and programming subculture.
  2. someone who is able to subvert computer security. If doing so for malicious purposes, the person can also be called a cracker.[1]
Today, mainstream usage of "hacker" mostly refers to computer criminals, due to the mass media usage of the word since the 1980s. This includes what hacker slang calls "script kiddies", people breaking into computers using programs written by others, with very little knowledge about the way they work. This usage has become so predominant that the general public is largely unaware that different meanings exist.[2] While the self-designation of hobbyists as hackers is generally acknowledged and accepted by computer security hackers, people from the programming subculture consider the computer intrusion related usage incorrect, and emphasize the difference between the two by calling security breakers "crackers" (analogous to a safecracker).

The controversy is usually based on the assertion that the term originally meant someone messing about with something in a positive sense, that is, using playful cleverness to achieve a goal. But then, it is supposed, the meaning of the term shifted over the decades and came to refer to computer criminals.[3]

As the security-related usage has spread more widely, the original meaning has become less known. In popular usage and in the media, "computer intruders" or "computer criminals" is the exclusive meaning of the word today. (For example, "An Internet 'hacker' broke through state government security systems in March.") In the computer enthusiast (Hacker Culture) community, the primary meaning is a complimentary description for a particularly brilliant programmer or technical expert. (For example, "Linus Torvalds, the creator of Linux, is considered by some to be a hacker.") A large segment of the technical community insist the latter is the "correct" usage of the word.

The mainstream media's current usage of the term may be traced back to the early 1980s. When the term was introduced to wider society by the mainstream media in 1983, even those in the computer community referred to computer intrusion as "hacking", although not as the exclusive definition of the word. In reaction to the increasing media use of the term exclusively with the criminal connotation, the computer community began to differentiate their terminology. Alternative terms such as "cracker" were coined in an effort to maintain the distinction between "hackers" within the legitimate programmer community and those performing computer break-ins. Further terms such as "black hat", "white hat" and "gray hat" developed when laws against breaking into computers came into effect, to distinguish criminal activities from those activities which were legal.

However, network news use of the term consistently pertained primarily to the criminal activities, despite the attempt by the technical community to preserve and distinguish the original meaning, so today the mainstream media and general public continue to describe computer criminals, with all levels of technical sophistication, as "hackers" and do not generally make use of the word in any of its non-criminal connotations. Members of the media sometimes seem unaware of the distinction, grouping legitimate "hackers" such as Linus Torvalds and Steve Wozniak along with criminal "crackers".[4]

As a result, the definition is still the subject of heated controversy. The wider dominance of the pejorative connotation is resented by many who object to the term being taken from their cultural jargon and used negatively,[5] including those who have historically preferred to self-identify as hackers. Many advocate using the more recent and nuanced alternate terms when describing criminals and others who negatively take advantage of security flaws in software and hardware. Others prefer to follow common popular usage, arguing that the positive form is confusing and unlikely to become widespread in the general public. A minority still use the term in both senses despite the controversy, leaving context to clarify (or leave ambiguous) which meaning is intended.

However, because the positive definition of hacker was widely used as the predominant form for many years before the negative definition was popularized, "hacker" can therefore be seen as a shibboleth, identifying those who use the technically-oriented sense (as opposed to the exclusively intrusion-oriented sense) as members of the computing community. On the other hand, due to the variety of industries software designers may find themselves in, many prefer not to be referred to as hackers because the word holds a negative denotation in many of those industries.

A possible middle ground position has been suggested, based on the observation that "hacking" describes a collection of skills and tools which are used by hackers of both descriptions for differing reasons. The analogy is made to locksmithing, specifically picking locks, which is a skill which can be used for good or evil. The primary weakness of this analogy is the inclusion of script kiddies in the popular usage of "hacker," despite their lack of an underlying skill and knowledge base.

Sometimes, "hacker" is simply used synonymously with "geek": "A true hacker is not a group person. He's a person who loves to stay up all night, he and the machine in a love-hate relationship... They're kids who tended to be brilliant but not very interested in conventional goals[...] It's a term of derision and also the ultimate compliment."[6]

Fred Shapiro thinks that "the common theory that 'hacker' originally was a benign term and the malicious connotations of the word were a later perversion is untrue." He found that the malicious connotations were already present at MIT in 1963 (quoting The Tech, an MIT student newspaper), and at that time referred to unauthorized users of the telephone network,[7][8] that is, the phreaker movement that developed into the computer security hacker subculture of today.

Types

Hacker culture

Hacker culture is an idea derived from a community of enthusiast computer programmers and systems designers in the 1960s around the Massachusetts Institute of Technology's (MIT's) Tech Model Railroad Club (TMRC)[9] and the MIT Artificial Intelligence Laboratory.[10] The concept expanded to the hobbyist home computing community, focusing on hardware in the late 1970s (e.g. the Homebrew Computer Club)[11] and on software (video games,[12] software cracking, the demoscene) in the 1980s/1990s. Later, this would go on to encompass many new definitions such as art, and Life hacking.

Security related hacking

Security hackers are people involved with circumvention of computer security. Among security hackers, there are several types, including:
White hats are hackers who work to keep data safe from other hackers by finding system vulnerabilities that can be mitigated. White hats are usually employed by the target system's owner and are typically paid (sometimes quite well) for their work. Their work is not illegal because it is done with the system owner's consent.

Black hats or crackers are hackers with malicious intentions. They often steal, exploit, and sell data, and are usually motivated by personal gain. Their work is usually illegal. A cracker is like a black hat hacker,[13] but is specifically someone who is very skilled and tries via hacking to make profits or to benefit, not just to vandalize. Crackers find exploits for system vulnerabilities and often use them to their advantage by either selling the fix to the system owner or selling the exploit to other black hat hackers, who in turn use it to steal information or gain royalties.

Grey hats include those who hack for fun or to troll. They may both fix and exploit vulnerabilities, but usually not for financial gain. Even if not malicious, their work can still be illegal, if done without the target system owner's consent, and grey hats are usually associated with black hat hackers.

Motives

Four primary motives have been proposed as possibilities for why hackers attempt to break into computers and networks. First, there is a criminal financial gain to be had when hacking systems with the specific purpose of stealing credit card numbers or manipulating banking systems. Second, many hackers thrive off of increasing their reputation within the hacker subculture and will leave their handles on websites they defaced or leave some other evidence as proof that they were involved in a specific hack. Third, corporate espionage allows companies to acquire information on products or services that can be stolen or used as leverage within the marketplace. And fourth, state-sponsored attacks provide nation states with both wartime and intelligence collection options conducted on, in, or through cyberspace.[14]

Overlaps and differences

The main basic difference between programmer subculture and computer security hacker is their mostly separate historical origin and development. However, the Jargon File reports that considerable overlap existed for the early phreaking at the beginning of the 1970s. An article from MIT's student paper The Tech used the term hacker in this context already in 1963 in its pejorative meaning for someone messing with the phone system.[7] The overlap quickly started to break when people joined in the activity who did it in a less responsible way.[15] This was the case after the publication of an article exposing the activities of Draper and Engressia.

According to Raymond, hackers from the programmer subculture usually work openly and use their real name, while computer security hackers prefer secretive groups and identity-concealing aliases.[16] Also, their activities in practice are largely distinct. The former focus on creating new and improving existing infrastructure (especially the software environment they work with), while the latter primarily and strongly emphasize the general act of circumvention of security measures, with the effective use of the knowledge (which can be to report and help fixing the security bugs, or exploitation reasons) being only rather secondary. The most visible difference in these views was in the design of the MIT hackers' Incompatible Timesharing System, which deliberately did not have any security measures.

There are some subtle overlaps, however, since basic knowledge about computer security is also common within the programmer subculture of hackers. For example, Ken Thompson noted during his 1983 Turing Award lecture that it is possible to add code to the UNIX "login" command that would accept either the intended encrypted password or a particular known password, allowing a backdoor into the system with the latter password. He named his invention the "Trojan horse". Furthermore, Thompson argued, the C compiler itself could be modified to automatically generate the rogue code, to make detecting the modification even harder. Because the compiler is itself a program generated from a compiler, the Trojan horse could also be automatically installed in a new compiler program, without any detectable modification to the source of the new compiler. However, Thompson disassociated himself strictly from the computer security hackers: "I would like to criticize the press in its handling of the 'hackers,' the 414 gang, the Dalton gang, etc. The acts performed by these kids are vandalism at best and probably trespass and theft at worst. ... I have watched kids testifying before Congress. It is clear that they are completely unaware of the seriousness of their acts."[17]

The programmer subculture of hackers sees secondary circumvention of security mechanisms as legitimate if it is done to get practical barriers out of the way for doing actual work. In special forms, that can even be an expression of playful cleverness.[18] However, the systematic and primary engagement in such activities is not one of the actual interests of the programmer subculture of hackers and it does not have significance in its actual activities, either.[16] A further difference is that, historically, members of the programmer subculture of hackers were working at academic institutions and used the computing environment there. In contrast, the prototypical computer security hacker had access exclusively to a home computer and a modem. However, since the mid-1990s, with home computers that could run Unix-like operating systems and with inexpensive internet home access being available for the first time, many people from outside of the academic world started to take part in the programmer subculture of hacking.

Since the mid-1980s, there are some overlaps in ideas and members with the computer security hacking community. The most prominent case is Robert T. Morris, who was a user of MIT-AI, yet wrote the Morris worm. The Jargon File hence calls him "a true hacker who blundered".[19] Nevertheless, members of the programmer subculture have a tendency to look down on and disassociate from these overlaps. They commonly refer disparagingly to people in the computer security subculture as crackers and refuse to accept any definition of hacker that encompasses such activities. The computer security hacking subculture, on the other hand, tends not to distinguish between the two subcultures as harshly, acknowledging that they have much in common including many members, political and social goals, and a love of learning about technology. They restrict the use of the term cracker to their categories of script kiddies and black hat hackers instead.

All three subcultures have relations to hardware modifications. In the early days of network hacking, phreaks were building blue boxes and various variants. The programmer subculture of hackers has stories about several hardware hacks in its folklore, such as a mysterious 'magic' switch attached to a PDP-10 computer in MIT's AI lab, that when turned off, crashed the computer.[20] The early hobbyist hackers built their home computers themselves, from construction kits. However, all these activities have died out during the 1980s, when the phone network switched to digitally controlled switchboards, causing network hacking to shift to dialing remote computers with modems, when pre-assembled inexpensive home computers were available, and when academic institutions started to give individual mass-produced workstation computers to scientists instead of using a central timesharing system. The only kind of widespread hardware modification nowadays is case modding.

An encounter of the programmer and the computer security hacker subculture occurred at the end of the 1980s, when a group of computer security hackers, sympathizing with the Chaos Computer Club (which disclaimed any knowledge in these activities), broke into computers of American military organizations and academic institutions. They sold data from these machines to the Soviet secret service, one of them in order to fund his drug addiction. The case was solved when Clifford Stoll, a scientist working as a system administrator, found ways to log the attacks and to trace them back (with the help of many others). 23, a German film adaption with fictional elements, shows the events from the attackers' perspective. Stoll described the case in his book The Cuckoo's Egg and in the TV documentary The KGB, the Computer, and Me from the other perspective. According to Eric S. Raymond, it "nicely illustrates the difference between 'hacker' and 'cracker'. Stoll's portrait of himself, his lady Martha, and his friends at Berkeley and on the Internet paints a marvelously vivid picture of how hackers and the people around them like to live and how they think."[21]
